1. Agreement to these terms
These Terms & Conditions (“Terms”) form a binding agreement between you and Rogatia Technologies (“Rogatia,” “we,” “us,” or “our”). By accessing our website, requesting a proposal, submitting a contact or careers form, or engaging our services, you agree to these Terms.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use our website or services.
2. Who we are and who we serve
Rogatia Technologies is a technology studio providing custom software development, web development, product design, and related digital services. We primarily serve businesses and organizations in the United States.
References to “United States” or “U.S.” mean the United States of America, including its states and territories.
3. Website use
You may use our website for lawful business and informational purposes only. You agree not to:
- Attempt to gain unauthorized access to our systems, accounts, or data
- Scrape, crawl, or harvest content in a manner that burdens or disrupts our services
- Upload malware, spam, or unlawful content through any form or upload feature
- Misrepresent your identity, affiliation, or authority when contacting us
- Use our site in violation of U.S. export controls, sanctions, or other applicable law
4. Services and statements of work
Descriptions of services on our website are for general information. Actual deliverables, timelines, fees, acceptance criteria, and intellectual property ownership for client engagements are governed by a separate proposal, statement of work (SOW), master services agreement (MSA), or other written contract signed by both parties.
If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls for that engagement.
5. Proposals, estimates, and pricing
Any quote, estimate, or proposal we provide is an invitation to negotiate unless we expressly state otherwise in writing. Pricing, schedules, and scope may change until a written agreement is executed.
Fees are typically quoted and payable in U.S. dollars (USD) unless we agree otherwise in writing. Applicable sales, use, or similar taxes may be charged where required under U.S. state or local law.
6. Intellectual property
The website, branding, text, graphics, logos, and other materials on this site are owned by Rogatia Technologies or our licensors and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from our site content without our prior written consent, except for limited personal or internal evaluation use.
Client project IP is handled under the applicable client agreement. Unless that agreement says otherwise, we retain ownership of our pre-existing tools, frameworks, libraries, know-how, and generic methodologies.
7. Third-party tools and links
Our website or services may reference or integrate third-party platforms, APIs, hosting providers, analytics, or open-source components. Those third parties have their own terms and privacy practices. We are not responsible for third-party sites or services we do not control.
8. Careers and applications
If you apply for a role through our careers experience, you agree that the information you submit is accurate and that we may process it as described in our Privacy Policy. Submitting an application does not create an employment relationship or guarantee an interview or offer.
9. Disclaimers
OUR WEBSITE AND PUBLIC MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the website will be uninterrupted, error-free, or free of harmful components, or that information on the site is complete or current.
10. Limitation of liability

Our aggregate liability arising out of website use under these Terms will not exceed one hundred U.S. dollars (USD $100). These limits do not apply where prohibited by law. Liability for paid client services is governed by the applicable client contract.
11. Indemnification
You agree to defend, indemnify, and hold harmless Rogatia Technologies from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, your violation of these Terms, or your violation of any law or third-party right.
12. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Washington, without regard to conflict-of-law rules. Exclusive venue for disputes arising from website use under these Terms shall be the state or federal courts located in Washington, U.S.A., and you consent to personal jurisdiction there.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us. Nothing in these Terms limits either party’s right to seek injunctive or other equitable relief for intellectual property misuse.
13. Changes
We may update these Terms from time to time. The “Effective date” at the top of this page will change when we do. Continued use of the website after an update means you accept the revised Terms.
